On September 16, 1943, Lawrence Jordan ("the miner") died in an explosion while working at the Three Point Coal Mine in Harlan, Kentucky.*fn1 His wife, petitioner Anna Jordan ("Jordan"), appeals from the decision and order of the Benefits Review Board ("the Board"), denying her survivor's claim under the Black Lung Benefits Act, as amended, 30 U.S.C. §§ 901-945 ("the Act"). For the reasons stated below, we AFFIRM in part and REVERSE in part.
